If their government passed this law, and it set a decent time delay before being enacted, it has had more than enough time to be challenged. 

What do you mean by 'challenged'?

Going to court.

IIRC, the British courts don't have the jurisdiction to strike down laws. There is no equivalent to Marbury v Madison.
